These Terms of Service (the “Terms”) apply to any use of websites, applications, and other online products and services (collectively, the “Services”) provided by Ruby’s Lab Corporation dba Self Told (“Self Told”, “we”, “us”, “our”). By creating an account or using the Services, you
are agreeing to the Terms.

These Terms apply to anyone who uses the Services, including website visitors, people who create an account, people who join someone else’s account, and people who use the Services without an account.

No one under the age of 18 is permitted to use the Services except with the permission and under the supervision of a parent or guardian who agrees to be bound by these Terms. 

We may update these Terms when necessary to reflect changes in our Services or the applicable law. If we make changes, we will revise the date at the top of the policy. If we make material changes, we will provide you with additional notice (such as adding a statement to our
website homepage or sending you a notification). We encourage you to review the Terms whenever you access the Services. By continuing to use the Services, you are agreeing to be bound by any updated Terms.

Self Told may suspend or stop your use of the Services at any time if we suspect that you failed to adhere to these Terms or the terms of our Privacy Policy.

Termination

We reserve the right to modify or discontinue the Services at any time. If we discontinue the Services, we will credit you a prorated portion of your subscription payment for then current term if applicable. However, if Self Told disables your access to the Services due to your breach of
the Terms, you will not be due any refund or credit for early termination of your subscription. You may terminate at any time by cancelling your subscription and stop accessing the Services. Any terms that by their nature are intended to continue (representations and warranties, your
liability for Your Content, disclaimer of warranties, indemnification, limitation of liability, dispute resolution, arbitration and class action waiver, miscellaneous) shall not be affected by termination.

Indemnification

Self Told makes commercially reasonable efforts to deliver our Services with high quality and high availability but we do not make any guarantees and you acknowledge that you are using the Services at your own risk. Our Services and any content therein are provided “as is”
and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless Self Told and our affiliates, officers, directors, agents and employees from and against any claims, allegations or investigations and any associated damages, fines,
costs or expenses arising out of or related to:
(a) your use of the Services;
(b) your violation of these Terms; or
(c) any claim related to your content, including a claim that your content violates the rights of a third party or caused damage to another person.

This indemnification obligation will continue after you stop using the Services.

Limitation of Liability

To the fullest extent permitted by applicable law, Self Told will not be liable under any theory of liability – whether based in contract, tort, negligence, strict liability, warranty, or otherwise – to you or to any other person for (a) any indirect, consequential, incidental, or special damages of any kind, (b) any amount, in aggregate, in excess of $10 or the amount paid by you to Self Told for the use of the Services during the 12 months preceding the claim, or (c) any matter beyond our reasonable control.

Dispute Resolution, Arbitration, and Class Action Waiver

Any dispute arising from these Terms or any use of the Services will be governed by and construed and enforced in accordance with the laws of Washington, without regard to conflict of law rules or principles (whether of Washington or any other jurisdiction) that would cause the
application of the laws of any other jurisdiction. You and Self Told agree to the exclusive jurisdiction of the state or federal courts of Washington and the United States, respectively, sitting in Seattle, Washington, to resolve any dispute that is not subject to mandatory arbitration specified below.

You and Self Told agree that any dispute between you and Self Told (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether the claims arise during or after the termination of these Terms) will be determined by binding individual (not class) arbitration. The arbitration shall be conducted in accordance with the Streamlined Arbitration Rules and Procedures by Judicial Arbitration and Mediation Services, Inc. (JAMS) then in effect. Any arbitration conducted in JAMS shall proceed individually before a
single arbitrator and shall not be consolidated with any other individual’s claims. The arbitration shall be held in Seattle, Washington.
